City Council to Review ADU Ordinance Update
City Council will review Accessory Dwelling Unit (ADU) Ordinance Update on Monday, November 25, 2024. The proposed update will amend the Lafayette Municipal Code entitled “Accessory Dwelling Unit” to comply with California State Law.
The California Legislature has approved a number of bills that, among other things, amended various Government Code sections to impose new limits on local authority to regulate ADUs and junior accessory dwelling units (JADUs). Article 3 of Chapter 6-5 of the Lafayette Municipal Code (LMC) was enacted to establish local regulations on ADUs and JADUs in compliance with state law.
On August 19, 2024, the Planning Commission held a public hearing to consider a proposed ordinance that would update LMC Article 3 of Chapter 6-5 to comply with recent changes in state law. Following the public hearing, the Planning Commission adopted Resolution 2024-08, recommending the City Council adopt the proposed ordinance. After the August 19th Planning Commission meeting, two additional ADU bills — AB 2533 and SB 1211 — were approved to take effect on January 1, 2025, and further amend State ADU Law. These changes were integrated into the City’s draft revised ADU Ordinance for reconsideration by the Planning Commission. On November 18, 2024, the Planning Commission held a public hearing on the proposed ordinance and adopted ITEM 12C City Council ZT01-24 ADU Ordinance Update Staff Report November 25, 2024 Page 2 of 7 Resolution 2024-13, forwarding an approval recommendation to the City Council.
